Capacity trade on the secondary market
The transmission system operator provides a service of trading in the contracted capacities on the secondary market under the conditions determined by the Network Code of the transmission system.
A transmission system user can transfer the capacity contracted on a particular transmission system entry and/or exit to another transmission system user by trading on the secondary market solely with a written consent of the transmission system operator.
A transmission system user can trade in the contracted transmission system capacities at the transmission system entry by:
(a) a transfer of the contracted capacity (a transfer of the transport contract)
(b) a transfer of the right to use the contracted capacity.
A transmission system user can trade in the contracted transmission system capacities at the transmission system exit by entering into agreement on a transfer of the transport contract.
LIST OF CAPACITY OFFER AND DEMAND ON THE SECONDARY MARKET
The transmission system operator publishes a List of capacity offer and demand on the secondary market on the first working day after the receipt of the properly completed forms by the transmission system users.

TRANSFER OF THE CONTRACTED CAPACITY/THE RIGHT TO USE CONTRACTED CAPACITY
Entering into a contract on capacity transfer the existing transmission system user (the “Transferer”) comes out of the contractual relationship with the transmission system operator, partially or entirely, and the new transmission system user (the ”Transferee”) takes over its contractual position.
Entering into a contract on a transfer of the right to use the contracted capacity does not have any influence on the contractual relationship between the transmission system operator and the existing transmission system user (the” Transferer”). The new transmission system user (the ”Transferee”) gains the right to use the contracted capacity of the Transferer and the leader of a balance group to which it belongs, gains the right to nominate and re-nominate.
The transmission system users that intend to conclude the contract on the transfer of the transport contract or the contract on the transfer of the right to use the contracted capacity shall previously deliver the notice on the secondary market trading, duly signed by both transmission system users, to the transmission system operator.
Notice on the secondary market trading
The Transferer and the Transferee that wish to trade in the capacities on the secondary market for the period of one or more consecutive calendar months shall deliver a Notice on trade
no later than 2 working days before the expiry of the month that precedes a month or the months that the trade refers to.
The Transferer and the Transferee that will trade in the capacities on the secondary market for the period of one or more consecutive gas days shall deliver a Notice on trade to the transmission system operator
no later than two working days prior to the first day of the period that the trade refers to.
